Terms of Service

These terms form a binding agreement between you and Farview Digital. By creating an account or using our service, you accept these terms. If you do not agree, do not use our service.
1. Agreement to Terms
These Terms of Service (Terms) govern your access to and use of the Farview online presence monitoring service. Farview Digital (ABN 77 995 655 930) provides the service. Our registered address is in Newcastle, NSW, Australia.
When we say "you" or "your", we mean the person or business entity that creates an account. When we say "we", "us", "our", or "Farview", we mean Farview Digital.
You must be at least 18 years old to create an account. By creating an account, you confirm you have the authority to enter into this agreement on behalf of yourself or the business entity you represent.
2. Description of Service
Farview is an online presence monitoring service for Australian small businesses. We monitor your website and online presence and send you plain-English alerts and monthly reports when something needs your attention.
Our monitoring covers:
- Website uptime and availability
- SSL certificate status and expiry
- Domain name registration and expiry
- Search engine optimisation (SEO) health
- Google Business Profile reviews
- Social media activity
- Competitor website activity
We deliver alerts and reports by email. We do not provide a dashboard, login portal, or app. We keep things simple.
We base our monitoring on publicly available data. We do not access private systems, private accounts, or any data you have not explicitly authorised us to access.
3. Account Registration and Security
When you subscribe to Farview, we create an account for you using the email address and details you provide during sign-up. You must provide accurate, current, and complete information.
You are responsible for maintaining the security of your account. This includes:
- Keeping your email address up to date so you receive alerts and reports
- Notifying us promptly if you believe your account has been compromised
- Not sharing your account credentials with unauthorised people
We may suspend or terminate your account if we reasonably believe it has been compromised or used in violation of these Terms.
4. Subscription and Pricing
Farview costs $29 per month AUD, billed in advance on a monthly basis. This price includes GST where applicable.
First month free: Your first month is free. When you sign up, we require a valid payment method, but you will not be charged until your first month ends. After the free month, your subscription automatically renews at $29 per month unless you cancel before the end of the free period. If you cancel during the free month, you will not be charged.
We may offer a free initial report before you subscribe. The free report does not create an ongoing subscription.
We reserve the right to change our pricing. If we increase the price, we will give you at least 30 days notice by email before the new price takes effect. You can cancel your subscription before the new price applies.
5. Payment Terms
We process all payments through Stripe, a third-party payment processor. By subscribing, you agree to Stripe's terms of service and privacy policy.
Automatic renewal: Your subscription automatically renews each month on the same date you originally subscribed. We charge your payment method on file at the start of each billing cycle.
Failed payments: If a payment fails, we will attempt to collect payment again over the following 7 days. During this 7-day grace period, your service continues uninterrupted. If payment still fails after 7 days, we will suspend your monitoring service until payment is resolved.
Suspension: While your account is suspended, we do not monitor your website or send you alerts. You can reactivate your service at any time by updating your payment method. We do not backdate alerts for the suspended period.
Taxes: All prices include Australian GST where applicable. If you are outside Australia, you are responsible for any local taxes, duties, or charges that apply to your subscription.
6. Cancellation and Refunds
You can cancel your subscription at any time. To cancel, email us at hi@farview.com.au.
Cancelling during the free month: If you cancel during your free first month, you will not be charged. Your service will end when you cancel. No payment will be taken from your card.
No refunds for voluntary cancellation after the free period: When you cancel your subscription after the free period, your service continues until the end of your current billing period. We do not offer refunds for the unused portion of a billing period when you choose to cancel. However, this does not affect your rights under the Australian Consumer Law. If we fail to provide the service with due care and skill, or the service does not meet a consumer guarantee, you may be entitled to a refund or other remedy regardless of this clause.
Data retention after cancellation: After your subscription ends, we retain your account data for 90 days. During this period, you can request a copy of your data or reactivate your account. After 90 days, we delete your data permanently.
We may also cancel your subscription in accordance with section 13 (Termination).
7. Acceptable Use
You agree to use Farview only for lawful purposes. You must not:
- Use the service to monitor websites or businesses you do not own or have no authority to monitor
- Reverse engineer, decompile, or attempt to extract the source code or underlying algorithms of our service
- Resell, redistribute, or sublicense our service or any data we provide to you
- Use the service in any way that violates applicable laws or regulations
- Attempt to interfere with, disrupt, or overload our systems
- Use automated tools to access our service without our written permission
We may suspend or terminate your access immediately if we reasonably believe you have breached this section.
8. Intellectual Property
Farview owns all intellectual property rights in and to the service, including our website, software, algorithms, monitoring methodology, report templates, brand assets, and all related documentation. These Terms do not transfer any intellectual property rights to you.
We grant you a limited, non-exclusive, non-transferable licence to use the reports and alerts we send you for your internal business purposes only. You may share reports with your professional advisers (such as your web developer or accountant) but you may not publish, sell, or distribute them publicly without our written consent.
9. Limitation of Liability
To the maximum extent permitted by law, our total liability to you for any claims arising out of or related to these Terms or our service is limited to the total fees you paid us in the 12 months before the claim arose.
We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, loss of business, or loss of goodwill, even if we have been advised that such damage may occur.
This limitation applies regardless of the legal theory on which the claim is based, whether in contract, tort (including negligence), statute, or otherwise.
Nothing in this section limits or excludes any rights you have under the Australian Consumer Law that cannot be limited or excluded.
10. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms is intended to exclude, restrict, or modify any right or remedy you have under the Australian Consumer Law or any other applicable legislation that cannot be excluded, restricted, or modified.
If we fail to provide the service with due care and skill, or the service is not fit for any purpose we have represented, you are entitled to a remedy under the Australian Consumer Law. This may include a refund, re-supply of the service, or compensation for any reduction in value.
11. Disclaimer
We provide our service on an "as is" and "as available" basis. We do not guarantee that the service will be uninterrupted, error-free, or completely accurate at all times.
Our monitoring is based on publicly available data. We do not guarantee that we will detect every issue affecting your online presence. We do not detect every possible outage, security vulnerability, or change in your online reputation. We are a monitoring and alerting service, not a security service, a managed IT service, or a replacement for professional web management.
We make no representations or warranties about the completeness, accuracy, reliability, or suitability of the information we provide. You use the information we provide at your own risk and should verify critical findings independently.
Nothing in this section excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.
12. Indemnity
You agree to indemnify and hold harmless Farview Digital, its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of the service
- Your breach of these Terms
- Your violation of any applicable law or regulation
- Any monitoring you request us to perform on websites or businesses you do not own or have authority to monitor
This indemnity survives termination of these Terms.
13. Termination
Termination by you: You can cancel your subscription at any time in accordance with section 6 (Cancellation and Refunds).
Termination by us: We may terminate your subscription in the following circumstances:
- For breach: If you breach these Terms, we may terminate your subscription immediately by giving you written notice
- For non-payment: If your payment fails and remains unresolved for 30 days after the failed payment, we may terminate your subscription and delete your data
- For convenience: We may terminate your subscription for any reason by giving you at least 30 days written notice. If we terminate for convenience, we will refund any prepaid fees for the remaining portion of your current billing period
Upon termination, your right to use the service ceases immediately. Sections 8 (Intellectual Property), 9 (Limitation of Liability), 11 (Disclaimer), 12 (Indemnity), and 14 (Governing Law) survive termination.
14. Governing Law
These Terms are governed by the laws of New South Wales, Australia. You and we submit to the exclusive jurisdiction of the courts of New South Wales and any court competent to hear appeals from those courts.
15. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will give you at least 30 days notice by email before the new terms take effect.
Your continued use of the service after the new terms take effect constitutes your acceptance of the updated Terms. If you do not agree with the updated Terms, you can cancel your subscription before they take effect.
For non-material changes (such as correcting typos or updating contact details), we may update the Terms without advance notice. We will always update the "Last updated" date at the top of this page.
